1. Нөхцөл хүлээн зөвшөөрөх

Та MoniChat-д бүртгэл үүсгэж, ашиглаж эхэлснээр энэхүү Гэрээг уншиж ойлгосон бөгөөд дагаж мөрдөхийг зөвшөөрч буйгаа баталгаажуулна. Энэхүү Гэрээ нь Апп ашиглах болон Апп дотор үүсгэх, хуваалцах, үзэх бүх хэрэглэгчийн контентыг зохицуулна.

2. Хэрэглэгчийн үүсгэсэн контент ба зохистой хэрэглээ

MoniChat нь хэрэглэгчдэд мессеж илгээх, медиа хуваалцах, бусадтай харилцах боломж олгоно. Бид бүх хэрэглэгчдэд аюулгүй, хүндэтгэлтэй орчныг бүрдүүлэхийг зорьдог.

Зохисгүй контент болон хүчирхийлэл, бусдыг зүй бусаар доромжилсон хэрэглэгчдэд үл хүлцэх (zero tolerance) бодлого хэрэгжүүлнэ.

Хэрэглэгч нь дараах агуулгатай контентыг үүсгэх, байршуулах, илгээх, хадгалахыг ХОРИГЛОНО:

• Бусдын нэр хүндэд халдсан, доромжилсон, дарамталсан, заналхийлсэн, хувийн нууцыг зөрчсөн агуулга
• Үзэн ядалт, ялгаварлан гадуурхалт, арьс өнгө болон бусад хэлбэрийн доромжлол
• Хүчирхийлэл, садар самуун, бүдүүлэг, порнограф, бэлгийн ил задгай агуулга
• Хууль бус үйл ажиллагааг сурталчилсан эсвэл санаатайгаар төлөвлөсөн агуулга
• Оюуны өмчийн эрх, зохиогчийн эрх, барааны тэмдгийг зөрчсөн агуулга
• Вирус, гэмтэлтэй файл, эсвэл бусдын төхөөрөмжид хохирол учруулах програм хангамж

3. Контент хяналт ба хэрэглэгчийн аюулгүй байдал

Манай бодлогыг хэрэгжүүлэх зорилгоор дараах механизмуудыг ашиглана:

3.1 Зохисгүй контентыг шүүх

Хэрэглэгч нь гомдол болон мэдээлэл (report) өгсөн даруй тухайн контент тухайн хэрэглэгчийн харагдацаас шууд нууна. Үүний зэрэгцээ админ багт дамжуулж, гар аргаар шалгаж дараах арга хэмжээг авна:

• Контентыг устгах
• Анхааруулга өгөх
• Хэрэглэгчийн эрхийг түр буюу бүр мөсөн хаах

3.2 Мэдээлэх (Flagging) механизм

• Мессеж дээр удаан дарж “Report” сонголтоор мэдээлнэ
• Мэдээлсэн даруй контент таны дэлгэцээс алга болно
• Админ баг шууд мэдэгдэл авангуут шалгалт хийнэ

3.3 Хаах (Blocking) механизм

• “Contact Info” хэсгээс хэрэглэгчийг блоклох боломжтой
• Блоклосон даруй харилцаа бүрэн зогсоно
• Систем админд зан үйлийн хяналтын мэдээлэл өгнө

3.4 Хөгжүүлэгчийн арга хэмжээ

Бид бүх гомдол мэдээллийг 24 цагийн дотор шалгана. Үүнд:

• Контент устгах
• Анхааруулга өгөх
• Хэрэглэгчийг түр/байнгын хориглох
• Чатыг устгах

4. Гэрээг цуцлах

Бид дараах тохиолдолд хэрэглэгчийн эрхийг шууд цуцлах эрхтэй:

• Энэхүү Гэрээг зөрчсөн
• Хууль бус эсвэл хортой үйл ажиллагаа явуулсан

Цуцлагдсан тохиолдолд Апп ашиглах эрх шууд дуусгавар болно.

5. Баталгааны мэдэгдэл

Апп нь “байгаа хэлбэрээр” (AS IS) болон “боломжит нөхцлөөр” (AS AVAILABLE) олгогдоно. Бид тасралтгүй ажиллагаа, алдаагүй байдалд баталгаа гаргахгүй.

6. Хариуцлагын хязгаарлалт

Манай тал дараах хохиролд хариуцлага хүлээхгүй:

• Шууд бус
• Санамсаргүй
• Тусгай
• Үр дагаварт
• Шийтгэлийн шинжтэй аливаа хохирол

7. Гэрээний өөрчлөлт

Бид энэхүү Гэрээг өөрчлөх эрхтэй. Томоохон өөрчлөлтийн талаар хэрэглэгчдэд мэдэгдэнэ. Хэрэглэгч Апп-ийг үргэлжлүүлэн ашиглах нь шинэ нөхцлийг хүлээн зөвшөөрсөнд тооцогдоно.

1. Acceptance of Terms

By creating an account and using MoniChat, you acknowledge that you have read, understood, and agree to be bound by this Agreement. This Agreement governs your use of the App and any user-generated content you create, share, or view within the App.

2. User-Generated Content and Acceptable Use

MoniChat allows users to send messages, share media, and interact with others. We are committed to providing a safe and respectful environment for all users.

There is zero tolerance for objectionable content or abusive users.

You agree NOT to use the App to create, upload, post, send, or store any content that:

• Is defamatory, abusive, harassing, threatening, or an invasion of a right of privacy of another person.
• Is bigoted, hateful, or racially or otherwise offensive.
• Is violent, vulgar, obscene, pornographic, or otherwise sexually explicit.
• Promotes illegal activities or discusses illegal activities with the intent to commit them.
• Infringes on any intellectual property or other right of any entity or person, including violating anyone’s copyrights or trademarks.
• Contains viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property.

3. Content Moderation and User Safety Mechanisms

To ensure compliance with our acceptable use policy and Apple's App Store Guidelines, MoniChat implements the following safety mechanisms:

3.1 Filtering Objectionable Content

MoniChat addresses objectionable content through a user-driven reporting and administrative review process. When a user reports a message, the reported content is immediately hidden from the reporting user's view, effectively filtering it from their experience without delay. All reported content is simultaneously escalated to our admin team for manual review. Upon review, our administrators will determine the appropriate action, which may include permanently removing the content, issuing a warning to the offending user, or suspending or banning the offending user's account. This process ensures that objectionable content is addressed promptly and that our community standards are consistently enforced.

3.2 Flagging Mechanism

Users have the ability to report any message (in 1-on-1 or group chats) that they believe violates this Agreement.

• How to Flag: You can report a message by long-pressing it and selecting the 'Report' option.
• Immediate Action: Upon reporting, the system immediately filters (hides) the reported content from your view.
• Admin Review: Our admin team is instantly notified of the report to ensure a final review and take appropriate action.

3.3 Blocking Mechanism

Users can block other users who are abusive or whose communication is unwanted.

• How to Block: You can block a user via their 'Contact Info' page.
• Immediate Action: Once blocked, the user is instantly removed from your friend list, and all communication capabilities between you and the blocked user are permanently disabled.
• Admin Monitoring: Our system logs these blocks to allow our admin team to monitor for patterns of abusive behavior.

3.4 Developer Action on Reports

We take reports of objectionable content and abusive behavior seriously. Our admin team will act on all reports within 24 hours. Actions may include:

• Removing the offending content.
• Issuing a warning to the user.
• Temporarily or permanently banning the user who provided the offending content.
• Deleting the chat.

4. Termination

We reserve the right to terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the terms of this Agreement. Upon termination, your right to use the App will immediately cease.

5. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted or error-free.

6. Limitation of Liability

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

7. Changes to this Agreement

We reserve the right to modify or replace this Agreement at any time. We will provide notice of any significant changes. Your continued use of the App after any such changes constitutes your acceptance of the new Agreement.
